Terms of Use

These Terms govern access to Kybernis website properties, audit experiences, dashboard capabilities, APIs, SDKs, and related services. They are written to set clear usage boundaries, responsibility lines, and commercial expectations.

1. Scope and acceptance

These Terms of Use govern your access to the Kybernis website, dashboard, audit experiences, APIs, SDKs, documentation, and any related services we make available through them. By accessing or using those services, you agree to these Terms.

If you are using Kybernis on behalf of an organization, you represent that you have authority to bind that organization to these Terms. In that case, references to 'you' include both you and the organization you represent.

If you do not agree to these Terms, do not access or use the services.

2. Eligibility and account responsibility

You must use Kybernis only in compliance with applicable law and only for legitimate business or technical purposes. You are responsible for the accuracy of information you submit through the site, including contact, audit, and sales intake forms.

If you create or access an account, you are responsible for maintaining the confidentiality of your credentials, controlling access to your account, and all activity that occurs under that account.

You must promptly notify Kybernis if you believe your account, API token, or organizational access has been compromised.

3. Permitted use and restrictions

You may use Kybernis to evaluate, test, govern, and audit agentic workflows and related systems. You may not use the services to interfere with availability, evade access controls, extract data you are not authorized to access, or conduct unlawful, harmful, deceptive, or abusive activity.

You may not reverse engineer, decompile, or attempt to derive the source code of any hosted portion of the service except to the limited extent such restrictions are prohibited by law.

You may not misuse public forms, audit tooling, or APIs for spam, credential harvesting, automated abuse, denial-of-service activity, or attempts to bypass tenant isolation, approval controls, or other safety mechanisms.

4. Customer materials and responsibility for workflows

You retain responsibility for the workflows, agents, prompts, code, data, configurations, and external systems that you connect to or evaluate with Kybernis. You are responsible for ensuring that you have the necessary rights to submit those materials and to authorize testing against them.

Kybernis does not assume responsibility for the business correctness of your workflows, the legality of your external actions, or the decisions your agents make. Our role is to provide tooling, guardrails, audit outputs, and related operational capabilities as described in the service.

You are also responsible for configuring your own external systems, approval processes, rollback plans, and operational policies in a way that is appropriate for your environment and risk profile.

5. Audit, beta, and evaluation features

Some Kybernis features may be offered as preview, beta, design-partner, audit, or evaluation functionality. Those features may change, be limited, or be discontinued. They may also be subject to additional usage constraints, rate limits, or operational conditions.

Audit reports, simulations, and recommendations are intended to help teams evaluate execution risk and control gaps. They do not replace legal review, security review, compliance analysis, or independent engineering judgment.

Where a feature is explicitly described as experimental or evaluation-only, you should not rely on it as the sole control for high-risk production use without validating it in your own environment.

6. Intellectual property and feedback

Kybernis and its licensors retain all right, title, and interest in the services, including software, visual design, documentation, trademarks, service marks, and related intellectual property, except for customer-owned materials you provide.

If you provide comments, suggestions, requests, or feedback about the service, Kybernis may use that feedback without restriction or obligation, provided that doing so does not disclose your confidential information in a manner inconsistent with our obligations to you.

No right or license is granted to you except the limited right to use the services in accordance with these Terms and any applicable written agreement.

7. Third-party services

Kybernis may rely on or integrate with third-party services such as identity providers, hosting providers, analytics providers, infrastructure platforms, email delivery providers, calendaring tools, or payment processors. Your use of third-party services remains subject to the terms and privacy practices of those providers.

Kybernis is not responsible for outages, failures, or policy changes caused by third-party providers, although we may work to mitigate their impact where commercially reasonable.

8. Availability, suspension, and termination

We may change, suspend, or discontinue all or part of the services at any time, including for maintenance, security, legal compliance, service protection, or product updates.

We may suspend or terminate access if we reasonably believe you have violated these Terms, created security or operational risk, or used the services in a way that could harm Kybernis, other customers, or third parties.

You may stop using the services at any time. Any provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and accrued rights, will survive.

9. Disclaimers

Except to the extent expressly stated in a separate written agreement, the services are provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, Kybernis disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Kybernis does not warrant that the services will be uninterrupted, error-free, or suitable for every workflow, architecture, framework, or regulatory environment. You are responsible for validating fitness in your own environment before relying on the services for production-critical use.

10. Limitation of liability

To the maximum extent permitted by law, Kybernis will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, business interruption, data, or opportunity arising out of or related to the services.

Except where a separate written agreement provides otherwise, Kybernis's aggregate liability arising out of or relating to the services will not exceed the amounts you paid to Kybernis for the specific services giving rise to the claim during the twelve months preceding the event giving rise to liability, or one hundred U.S. dollars if no such fees were paid.

11. Changes to these Terms

Kybernis may update these Terms from time to time. When we do, we will update the effective date on this page. If a change is material, we may provide additional notice through the website, dashboard, or other reasonable means.

Your continued use of the services after updated Terms become effective constitutes acceptance of the updated Terms.
